Sri Lankan navy accused of damaging Indian fishing nets

The Sri Lankan navy has reportedly damaged the fishing nets of some 20 Indian boats, who were fishing near Katchatheevu, reports PTI.

Fishermen Association president S Emerit stated that 535 boats had left Rameswaram to go fishing, when Sri Lankan navy personnel in 5 navy vessels approached them near Katchatheevu. The Sri Lankan troops then proceeded to snap the nets of 5 boats and threatened the fishermen at gunpoint, said Emerit.

The latest incident comes as the Sri Lankan navy handed over 94 Tamil Nadu fishermen to the Indian Coast Guard, releasing them from custody.

Earlier this week, Tamil Nadu Chief Minister O Paneerselvam wrote to Indian Prime Minister Narendra Modi regarding the Sri Lankan navy's treatment of Tamil Nadu fishermen.

Gotabaya to meet with India's NSA next week

The Sri Lanka Defence Secretary Gotabaya Rajapaksa is to meet with India's National Security Advisor (NSA), Ajit Doval, in New Delhi next week for "high-level" talks, reportsThe Hindu. 

Sources in New Delhi, confirmed the meeting however did not "get into the details", the paper added. 

The meeting follows talks between the two countries at the Second Annual Defence Dialogue held in Colombo earlier this month. See here for more.

SL expresses concern over ECJ court ruling, warns of pressure from 'pro-LTTE activists'

The Sri Lankan Government  expressed concern regarding a decision by the European Court of Justice (ECJ) to call for the annulment of restrictions placed against  organisations and individuals allegedly linked to the LTTE.

Warning the European Council of pressure "pro-LTTE activists" the Sri Lankan government offered to provide further assistance to maintain the terrorist listing of the Liberation Tamil Tigers of Tamil Eelam (LTTE).

"Sri Lanka is further mindful that the ECJ decision may have an impact including from a security perspective, on the large majority of Sri Lankans living in EU territory, as well as EU citizens of Sri Lankan origin, who are likely to come under pressure once again by pro LTTE activists," read the Ministry of External Affairs Statement.

Miss,Jayalalithaa has been released on bail

Tamil Nadu’s former chief minister Jayaram Jayalalithaa has been granted bail by India’s Supreme Court.

Jayalalithaa was forced to resign her position as chief minister last month after being sentenced to 4 years in prison for corruption.

Her lawyers had argued for her release on bail due to her health condition and are appealing her conviction.

The Supreme Court ordered her to "complete all paperwork" relating to the appeal against her conviction within two months in the Karnataka high court, warning it would not give her "a day more" if she failed to complete the necessary procedures.

Vavuniya high court operates without judge

The high court in Vavuniya has been without a judge since the retirement of the previous judge nearly two months ago, reports the Uthayan. 

Due to the absence of a judge, several important cases, including a large number of cases under the Prevention of Terrorism Act (PTA) are being postponed, law sources told the daily. 

Relatives of detainees held under the PTA say they are required to go back and forth from the court as a result of the continuous postponements. 

The head of the Vavuniya Lawyers Association, Kanthasamy Thayaparan told Uthayan that administrative activities are also being affected by the failure to appoint a new judge.

பிறந்து இறந்த ஒருநாளான இரு சிசுக்களை தென்மராட்சிப் பகுதியில் பற்றைக்குள் இருந்து பொலிஸார் மீட்டுள்ளதாக கொடிகாமப் பொலிஸ் பொறுப்பதிகாரி எல்.பி.ரி பத்திரன தெரிவித்தார்.

ஒன்று எழுதுமட்டுவாள், மிருசுவில் பகுதியிலிருந்தும் மற்றையது மந்துவில் கிழக்கு பகுதியிலிருந்துமே இவ்விரு சிசுக்களின் சடலங்களும் மீட்கப்பட்டுள்ளன.

பிரான்ஸ் நாட்டைச் சேர்ந்த பெண் ஒருவர், திருமணமான ஒரு மணி நேரத்திலேயே குழந்தையை பெற்றெடுத்த சம்பவம் பரபரப்பை ஏற்படுத்தி உள்ளது.

பிரான்ஸ் நாட்டின் மேற்கு பகுதியில் உள்ளது ஜலாய்ஸ் நகரம். இந்த நகரத்தை சேர்ந்த காதல் ஜோடி ஒன்று குழந்தை பெறுவதற்கு முன் திருமணம் செய்து கொள்ள முடிவு செய்தனர்.

காதலி நிறை மாத கர்ப்பிணியாக இருந்தார். இன்று(ஜூலை மாதம் 14ஆம் திகதி) குழந்தை பிறக்கும் என மருத்துவர்கள் நாள் குறித்திருந்தனர்.

எனவே முன்னதாகவே திருமணத்தை முடிக்க திட்டமிட்டு, கடந்த 8ஆம் திகதி திருமணத்துக்கு ஏற்பாடு செய்தனர். உறவினர்கள், நண்பர்கள் புடை சூழ திருமணம் இனிதே நிறைவேறியது.

வந்த உறவினர்களுடன் நின்று போட்டோவுக்கு போஸ் கொடுத்து கொண்டிருந்த மணமகளுக்கு திடீரென பிரசவ வலி ஏற்பட்டது. உடனடியாக ஆம்புலன்சுக்கு போன் செய்யப்பட்டது.

ஆனால் அவர்கள் வருவதற்குள் திருமணக் கூடத்திலேயே மணப்பெண் ஆண் குழந்தையை பெற்றெடுத்து விட்டார். வந்த உறவினர்கள், மணமக்களுடன் குழந்தையையும் வாழ்த்தி விட்டு சென்றனர்.

மூன்று புலிகளுக்கு தன்னை இரையாக்கி இளைஞர் ஒருவர் தற்கொலை செய்து கொண்ட சம்பவம் டென்மார்க்கில் இடம்பெற்றுள்ளது.

மேற்படி நபர் கொப்பென்ஹேஜன் மிருகக்காட்சிச் சாலையில் அபாயகரமான புலிகள் இருந்த, அடைக்கப்பட்ட வேலியைத் தாண்டிக் குதித்து உட்பிரவேசித்து அங்கிருந்த 3 சைபீரியப் புலிகளுக்கு இரையாக்கிக் கொண்டுள்ளார்.

செவ்வாய்க்கிழமை இரவு இடம்பெற்ற இந்தச் சம்பவம் குறித்து சர்வதேச ஊடகங்கள் வியாழக்கிழமை செய்தி வெளியிட்டுள்ளன. மறுநாள் காலை மேற்படி மிருகக்காட்சிச் சாலைக்கு பணியாளர் ஒருவர் வந்த போது, இளைஞரின் உடலை 3 புலிகளும் கடித்துக் குதறி சின்னாபின்னப்படுத்திக் கொண்டிருப்பதைக் கண்டு அதிர்ச்சியடைந்துள்ளார்.

தற்கொலை செய்து கொண்ட இளைஞன் கொப்பென்ஹேஜன் நகரிலுள்ள மாடிக் குடியிருப்பில் தனது குடும் பத்தினர் வசித்த வீட்டிற்கு அண்மையில் தனிமையில் வாழ்ந்து வந்ததாகத் தெரிவிக்கப்படுகிறது. அவரது விபரீத தற்கொலையை அறிந்து அவரது குடும்பத்தினர் அதிர்ச்சிக்குள்ளாகியுள்ளனர்.

சீனாவில் உள்ள குயாங்சி மாகாண அரசாங்கம் வித்தியாசமான பரிசு ஒன்றை அறிவித்தருக்கிறது. அங்கு பாய்ந்தோடும் லியுஜியாங் நதியில் மனிதர்களை தாக்கும் சிறிய வகை அபாயகர மீன்கள் இருப்பதாக கூறப்படுகிறது.

சமீபத்தில் ஆற்றில் இறங்கிய 2 பேரை இந்த மீன்கள் கொடூரமாக தாக்கின. இதில் பலத்த காயத்துடன் 2 பேரும் தப்பினார்கள்.

இதனை அடுத்து இந்த கொடூர மீன்களை உயிருடன் பிடித்தாலோ அல்லது சாகடித்தாலோ அவருக்கு பரிசு அளிக்கப்படும் என அறிவிக்கப்பட்டுள்ளது. வேட்டையாடப்படும் ஒவ்வொரு மீனுக்கும் 180 டொலர் பரிசு வழங்கப்படும் என்று அறிவித்துள்ளது.

ஜெமினி என்ற செல்லப் பெயரைக் கொண்ட பூனைக்குட்டி ஒன்று இரண்டு தலைகளுடனும், 24 கால் விரல்களுடனும் பிறந்து ஆச்சரியத்தை ஏற்படுத்தியுள்ளது.

எனினும் துரஷ்டவசமாக பிறந்து மூன்றே நாட்களே ஆன வேளையில் போதிய ஆரோக்கியம் காணப்படாமையினால் இன்றைய தினம் இறைவனடி சேர்ந்துள்ளது.

As three planes violated the flight-ban in airspace over LA during his visit:

US: Two F-16 fighters were scrambled Thursday after three small planes violated a flight ban imposed for a fundraising visit by President Barack Obama in California, officials said.

The military jets intercepted a Cessna 206 at around 9:00 am (1600 GMT) and a Cherokee PA 28 about 30 minutes later in airspace over Los Angeles, said North American Aerospace Defense Command spokesman Lieutenant Commander William Lewis. Both planes are single-engine, light aircraft models.

“The fighters responded after the aircraft entered a temporary flight restricted area, and escorted them until they departed the area,” Lewis said in a statement.

Earlier in the morning, a Mooney M20 violated the airspace near Fullerton, east of Los Angeles, at around 6:00 am and was forced to land at Chino Airport, said a spokesman for the Federal Aviation Administration (FAA).

The incidents brought to six the number of aircraft intercepted in California for violating air space restrictions during Obama fundraising visits since the start of this year.

On Wednesday, an F-16 fighter intercepted a Cessna airplane until it landed at Camarillo Airport in Ventura County. On May 11, a small private plane was intercepted by fighter jets and forced to land at El Monte Airport.

On February 16, a Cessna was intercepted by two F-16s and forced to land at Long Beach Airport, south of Los Angeles, where authorities found marijuana on the plane.

Obama arrived in Los Angeles on Wednesday from San Francisco, and left Thursday for Las Vegas, a few hours after the latest air security incidents.

Pakistan will not be easy to beat in second game:

The Pakistanis, now that they have dented the confidence of the Sri Lankans by beating them by six wickets in a overs shortened First of Five one-day internationals due to rain, will be looking to further inflict wounds on the home team.

The second game will be played today under lights at the Pallekelle Stadium and it is hoped that the weather that took a sudden change which required three stoppages for rain, will relent and allow a full quota of 50 overs to be played.

That dreaded pair of Duckworth and Lewis who smile when it rains because they will be called to play, stepped in to reduce the game by 8 overs after the third stoppage.

Reduction of overs

The reduction of overs probably went against the Lankans. When it rained for the third time and play was stopped Sri Lanka were gasping at 107 for7.

D and L were then called in and they reduced the game to a 42 over affair. In the remaining 5 overs with the cream of the Lanka batting on the bench, they could post only 28 more runs and the final score of 135 for 8 was insufficient to stall the Pakistani batsmen from going on the rampage and getting those runs in 42 overs.

Now that the Pakistanis have their tails up, after squaring the Twenty20 series and going one up in the best of five one-dayers, the Lankans will have to play from out of their skins to win the series.

High esteem

The Lankans are held in high esteem in the 50 over format.

If they gift this series to Pakistan, it will be a calamity and no excuses however good could be accepted.

When the Lankans won the first Twenty20, they had the visitors, to use boxing parlance on the ropes.

This was obvious by he looks of worry on their faces.

Then when the Lankans were expected to continue the good work and shoot down the visitors in the next game, they rest two of their cricketing drones – skipper Mahela Jayawardene and Lasith Malinga – and bring the confidence and smiles back to the faces of the visitors by gifting the second game.

Cricketers and cricket fans are furious. They reckon that the cricket management, the think tanks and Sri Lanka Cricket should apologize to the public for this irresponsibe act and poor thinking.

A bit overcast

At the time of writing the weather here looks a bit overcast. But today’s weather is so unpredictable, that there could be a sudden change for the better or worse before the game starts. Surprisingly the Lankans seem to have lost that ruthlessness that was associated with their game. The hunger and the urgency seem to have deserted them.

As we have always been saying, and reiterate, a psychologist could be of great help at this juncture. It is time that the three batting guns in the Lankan batting line up fire, and fire to destroy the enemy.

Chandimal in a tangle

Skipper Jayawardena, Dilshan and Sangakkara cannot afford to keep failing. Young Dinesh Chandimal from whom much was expected, seems to have got himself into a tangle. He does not seem to know which ball to pick to hit. Tharanga, Thirimanne, Mathews and Perera must make runs and big runs at that.

When the top order fails, there is nothing that the tailenders could do to swell the total. So it is paramount that the top order put runs on the board for the bowlers to deliver.

And the bowlers, especially Malinga, Kulesekera, Mathews and Perera must endeavour to bowl wicket to wicket and good line and length.

They could take a lesson from the Pakistani bowlers – Gul, Tanvir and Sami who were always positive and attacking.

Quite adequate

The Pakistani batting is quite adequate and batsmen of the caliber of Mohamed Hafeez, Younis Khan although he failed, Misbah, Umar Akmal and Sahid Afridi can turn a game on its head with their clever thinking and devastating stroke play.

There is the possibility of Sri Lanka making changes, while the Pakistanis could go in with the same match winning squad.

While the visitors will be looking to further rub the Lankans, here’s hoping that the homesters would have regained their lost form and squared the series going into the next three at the R.Premadasa Stadium.

Special skills needed of states in facing challenges

Text of the Romesh Jayasinghe Memorial Oration delivered by Dr Amrith Rohan Perera PC at Sri Lanka Foundation Institute, Colombo on May 30, 2012.

While these are certainly significant factors which have a major impact on the current political and law-making agenda, it would nevertheless be an over-simplification to conclude from them, that the major powers have the decisive say in dictating the contemporary international agenda.

It is an undeniable fact that the momentum that was generated towards the establishment of an International Criminal Court by adopting the Rome Statute, in 1998, a decisive landmark in postwar legal developments, could not be derailed, despite the objections of the major power in the post Cold War order. The same could be said with regard to developments relating to the environment, ultimately leading to the adoption of a Framework Convention on Climate Change, though of course, critical issues still remain on the Environmental Agenda.

It must also not be forgotten that, through the consummate efforts of the developing states, backed up by an effective campaign by the non-governmental organisations, an OECD initiative to frame a Multi-lateral Agreement on Investment (MIA) was thwarted, as representing a rigid 'legal straight-jackert', heavily tilted towards the protection of investors, at the expense of the flexibility that should be vested in sales to legislate in the public interest. What has since emerged, is a network of Bi-lateral Investment Promotion and Protection Treaties (BITs), seeking to maintain a far equilibrium between the protection of rights of investors as well as the inherent rights of host states to exercise regulatory powers in the larger public interest.

The international agenda continues to present complex and challenging issues which call for continuing vigilance and diplomatic and legal skills on the part of state representatives. Occupying a position of prime importance among them, are issues that vitally affect the Sovereignty of States and State Officials, long regarded as a fundamental Principles of International Law, on which the current international legal order is based.

Recent jurisprudence of the International Court of Justice (ICJ), on going discussions and debates in the International Law Commission on the topic of 'Immunity of State Officials from Foreign Criminal Jurisdiction' and the increasing tendency on the part of domestic courts of foreign states, to assert jurisdiction over high level state officials of third states, have collectivity brought into sharp focus, certain tensions that have emerged among diverse and contending principles.

International Criminal Court

The on-going debates on these issues, it is said, revolve around 'two major values protected by International Law', namely the Immunity of State Officials from jurisdiction of foreign courts, an integral aspect of sovereign equality of states and an essential prerequisite to preserve the stability of international relations, and the other value being the obligation to avoid impunity, by granting immunity across the board, in situations where grave crimes, described as crimes 'which shock the conscience of mankind' are alleged to have been committed by persons enjoying immunity.

These values call for a careful assessment of the scope of immunity, the range of officials, who by virtues of their functions and as representing the state, should enjoy absolute immunity and the delicate question of possible exceptions to immunity in respect of a category of crimes referred to as 'grave crimes' under International Law.

While these difficult questions are debated and grappled with, there is a continuing need for representatives of developing states, to be engaged with the law-making process. Today the much heralded International Criminal Court is not free from allegations of an anti-African bias. In order to make an impact on this sensitive norm creating process, the diplomat and the lawyer must be conscious of the fact that one is entering an uncertain terrain.

It is an area of the law which is in evolution. In delivering a recent Judgement in February this year, in the Jurisdictional Immunities of States Case, upholding the immunity of Germany form the jurisdiction of Italian courts in respect of wrongful acts committed during the Second World War, the International Court of Justice was nevertheless, careful to caution that “given that the court's task is to apply the existing law, nothing in the court's judgement today prevents the continuing evolution of the law on state immunity. In the past century the law on state immunity has evolved considerably in a manner that has significantly circumscribed the circumstances in which a state is entitled to immunity. It is possible that further exceptions to state immunity will continue to develop in the future. The court's judgement applies the law as it exists today.”

What the statement underlines in the fact that the International Law making process in a state of evolution. Classical concepts perceived as well settled and immutable, are coming under increasing stress and strain, as new norms underlining the relationship between the state and the individual contend with established principles, as they struggle to find expression through state practice. These developments are pushing back the frontiers of established legal concepts such as absolute state sovereignty, on which the traditional international legal order is based. In this scenario, it is important that those engaged in the conduct of intentional relations and in the practice of International Law, recognise the evolving nature of the law, appreciating the inextricable linkage and the subtle interplay between emerging norms, and the underlying political factors.

Political adversaries

In this complex unfolding scenario, what is the role and function of the international lawyer and diplomat? I would say it lies in the search for a shared surface, with an understanding of the rationale and underlying values of the contending norms and principles. This idea of reaching a 'shared surface' is effectively captured in an Essay by the eminent Finnish Jurist, Martti Koskenniemi, Global Professor of International Law, New York University Law School and a former Member of the International Law Commission, entitled 'What is International Law For?'.

“... It is Intentional Law's formalism that brings political antagonists together, as they invoke contrasting instrumental understandings of its rules and institutions.

In the absence of agreement over or knowledge of the 'true' objectives of political community that is to say in an agnostic world the pure form of International Law provides the shared surface the only such surface on which political adversaries recognise each other as such and pursue their adversity in terms of something shared, instead of seeking to attain full exclusion outlawry of the other. Its value and its misery, lie in its being the fragile surface of political community among social agents - states, other communities, individuals, who disagree about social purposes, but who do this within a structure, that invites them to argue in terms of an assumed universality.”

This statement encapsulates the core value and role of International Law in contemporary diplomacy.

The international lawyer and diplomat must collectively engage in that task of reaching that shared surface, eschewing the temptation of drowning out of the voice of the 'adversary', but rather, explore every avenue pointing towards middle ground.

Such accommodation can be reached through rational balanced legal and political reasoning and arguments, which while preserving one's vital interests, keeps open the possibility of meeting the concerns of the other. In the long term, such a calibrated approach is the best guarantor of a state's own national interests. Above all, what must be eschewed is the temptation to adopt a 'zero-sum approach' in the milieu of international negotiations.

Romesh Jayasinghe's career in the Foreign Service was reflective of a constant seeking of balance and harmony on a multitude of complex issues which I adverted to at the beginning of this Oration. It was a continuing and alas, an unfinished search for that shared surface for the effective conduct of diplomacy, in an increasingly antagonistic world. This is the rich legacy that Romesh's life has left behind for those that are to follow the difficult, yet challenging path of conducting diplomacy in current times.
